Injured workers ability to recover benefits is subject to a deadline where a claim must be filed. If the worker fails to file a claim before the expiration of the time period, then they forfeit the right to recover.
Under Illinois Workers’ Compensation Act, you have 3 years from the date of your injury to file a claim for benefits. For example, if you were injured at your job on January 1, 2021, you have until January 1, 2024 to file a claim. By filing a claim, we are referring to filing an Application for Adjustment of Claim with the Illinois Workers’ Compensation Commission.
There is an exception workers should be aware of. If as result of your injury you receive disability pay or your employer paid a medical bill, then its 2 years from the last disability payment you received or 2 years from the date the last medical bill was paid.
